1. About Us

Endorphins Entertainment is a full-service creative solutions agency offering six umbrella services:

  1. Digital Marketing
  2. Design
  3. Films
  4. Public Relations (PR)
  5. Events
  6. Strategy

We work with brands to create impactful campaigns, content, and experiences.

2. Use of Our Website

  • The content on our website is for informational purposes only and is subject to change without prior notice.
  • You may not copy, distribute, or reproduce any content from our website without prior written consent. Otherwise it will lead to legal actions.

3. Service Agreements

3.1 Project Scope

At Endorphins, we begin all projects with a detailed scope of work that outlines deliverables, timelines, and costs. Changes to the agreed scope may result in additional charges and timeline adjustments.

3.2 Client Responsibilities

Clients must:

  • Provide accurate and complete information

  • Supply necessary materials, content, and assets in a timely manner

  • Respond to requests for feedback within agreed timeframes

  • Ensure they have rights to any materials they provide

3.3 Approval Process

Client approval is required at designated milestones. Failure to provide feedback within the specified timeframe (typically 3-5 business days) will be considered approval to proceed.

4. Payment Terms

4.1 Fees and Payment Schedule

  • Payment terms will be specified in individual project agreements

  • Certain projects may require an advance deposit before work begins.

  • Late payments may incur interest charges of 1.5% per month

  • All fees are exclusive of applicable taxes unless otherwise stated

4.2 Refund Policy

Refunds are generally not provided for completed work. In cases of project cancellation, clients are responsible for payment of work completed to date.

5. Intellectual Property

5.1 Client-Provided Materials

Clients warrant they own or have proper licenses for all materials provided to us and indemnify us against any claims arising from their use.

5.2 Work Product

Upon full payment, clients receive rights to final deliverables as specified in the project agreement. We retain the right to use work for portfolio and promotional purposes unless otherwise agreed.

5.3 Third-Party Materials

Any third-party materials (stock photos, fonts, software) used in projects may require separate licensing by the client.

6. Confidentiality

We maintain strict confidentiality regarding client information and projects. We may require clients to sign separate non-disclosure agreements for sensitive projects.

7. Liability and Warranties

7.1 Service Warranty

We warrant that services will be performed in a professional manner consistent with industry standards.

7.2 Limitation of Liability

Our liability is limited to the total amount paid by the client for the specific project. We are not liable for indirect, consequential, or punitive damages.

7.3 Digital Marketing Disclaimer

Results from digital marketing campaigns cannot be guaranteed. Performance depends on various factors including market conditions, competition, and client cooperation.

8. Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, or technical failures.

9. Termination

9.1 Client Termination

Clients may terminate projects with written notice but remain liable for work completed and non-refundable expenses incurred.

9.2 Agency Termination

We reserve the right to terminate projects for non-payment, breach of terms, or client conduct that impedes project completion.

10. Website Usage

10.1 Acceptable Use

Users must not:

  • Engage in unlawful activities

  • Transmit harmful or malicious content

  • Attempt to gain unauthorized access to our systems

  • Infringe on intellectual property rights

10.2 Content Accuracy

While we strive for accuracy, we make no warranties regarding website content and reserve the right to modify information without notice.

11. Privacy

Our Privacy Policy, incorporated by reference, governs the collection and use of personal information.

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by and construed in accordance with the laws of India.

12.2 Mediation and Arbitration

Disputes will first be addressed through good-faith mediation. If unsuccessful, binding arbitration may be required as specified in project agreements.

13. General Provisions

13.1 Entire Agreement

These Terms, together with specific project agreements, constitute the entire agreement between parties.

13.2 Severability

If any provision is deemed invalid, the remaining provisions remain in effect.

13.3 Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on our website with the updated date.
